General conditions and terms

WKE Konzert- & Eventveranstaltungs GmbH, FN 445810d, UID ATU 70 26 57 13, DVR number 09 / 260 3711 (hereinafter referred to as "WKE") with its registered office at Annagasse 6/1/II., 1010 Wien, is a member of the Vienna Chamber of Commerce, Leisure Enterprises Section. It holds a trade license for the free trade "Organization of Events" and "Concert Agency."
WKE organizes the Schönbrunn Palace Concerts (hereinafter referred to as CONCERTS).
The CONCERTS take place in the Orangery, in the Great Gallery, in the White and Gold Room (not barrier-free) of the Schönbrunn Palace, or in the Palace Theater. It is noted that the customer has no claim to the holding of the concert in a specific concert hall.

Tickets – Purchase & Booking:

Tickets can be purchased on-site if available, with payment made in cash or by credit card. Tickets can be purchased online in the web shop subject to availability. When booking online in the web shop, payment is made by credit card. When purchasing tickets through an intermediary, payment can be made in cash, by credit card, or by bank transfer. Each ticket is only valid upon full payment by the end customer. The prices indicated are gross prices, including statutory value-added tax and all other duties and surcharges. The provision of the credit card number and the expiration date of the credit card authorizes WKE to charge the total amount of the order to the credit card following booking confirmation, even without the original signature.

Tickets – Delivery, Use:

All tickets and/or documents related to package bookings must be picked up at our reservation centre at the street-side main entrance of the Orangery or directly at our meeting point at the main entrance of the palace building at least 30 minutes before the booked service; the specific pickup location will be indicated either on the reservation confirmation or (in the case of an intermediary) on the voucher. The intermediary must indicate the pickup location on their voucher. WKE is not liable for incorrect or non-communicated information by the intermediary. Admission tickets must not be misused, copied, or altered. By purchasing the admission ticket, the customer also accepts WKE's General Terms and Conditions and the house rules of the event venue.

Exchange / Return / Cancellation of Tickets / Event Cancellation, Changes / Refunds:

Since the organizer provides a leisure service according to these terms and conditions for a specific date, the right of withdrawal in distance selling according to §11 FAGG is excluded in accordance with §18 Abs. 1 Z 10 FAGG. Therefore, withdrawal from the purchase contract is not possible. The date and number of tickets must be checked for accuracy before purchase, especially in the case of online bookings, to ensure that all details are correctly displayed in the shopping cart. Replacement for tickets that are not used or only partially used (e.g., due to late arrival) is excluded, as is replacement for lost tickets. Every ticket order is binding and obligates the buyer to accept and pay for the ordered tickets.

Minor or objectively justified changes to the cast or program are reserved. In the event of a cancellation, postponement of performance time and/or venue, change of concert venue, or changes to the program or cast, no expenses (e.g., travel, hotel, advance sale fees, or shipping costs) will be reimbursed.

Up to 24 hours before the start of the event, customers who booked directly with WKE may cancel the concert ticket (excluding package bookings) in writing free of charge and will be refunded the full amount paid by WKE. Up to 48 hours before the start of the event, customers who booked directly with WKE may cancel the respective package booking in writing free of charge and will be refunded the full amount paid by WKE. Refunds are made exclusively via credit card refund or bank transfer; cash refunds are excluded. A refund of the ticket price for non-attendance by the end customer is excluded. If the customer purchased through an intermediary, they must also cancel their booked service with the intermediary. When booking our services through third parties, the terms and conditions and cancellation policies of the respective companies apply.

Data Protection:

The customer acknowledges that the data provided electronically by them is processed electronically by WKE for the purpose of initiating and processing the contract. They also agree to the transfer of this data within the framework of the legal provisions and restrictions of the General Data Protection Regulation (GDPR) and the Data Protection Act (DSG) to WKE group companies (parent and/or subsidiary companies). The customer is informed that this consent can be revoked at any time. The customer is advised that photos may be taken at the concert venue before, during, and after the concert and may be published for documentation and/or promotional purposes. In the case of image and sound recordings by the concert organizer or by authorized third parties, the customer acknowledges and agrees that any recordings made of them may be used without compensation and without restriction.

House Rules, Jurisdiction, Law:

By purchasing their concert ticket, each customer accepts the house rules of the respective venue. The house rules of the Orangery are posted at the cloakroom. The house rules of Schönbrunn Palace can be found at: www.schoenbrunn.at/park-und-hausordnung. The place of jurisdiction for proceedings against corporate customers and/or private customers from abroad is the competent court in Vienna; for private customers from within Austria, it is their local and competent court. Austrian law applies, excluding the conflict of law rules.

General:

According to the Vienna Event Act, each customer is required to check their coat. A fee is charged for cloakroom storage. Valuables contained in or attached to a checked garment, bag, or other items are not covered by the storage contract. No liability is accepted for garments and other items left at the cloakroom or for garments and other items not left at the cloakroom, unless the damage was caused intentionally or by gross negligence on the part of WKE. During the concert, any form of audio and video recording, as well as the use of mobile phones and electronic devices, is strictly prohibited. Beverage consumption is only permitted in the bar area and garden.

Instructions:

The (security) instructions given by the event and security staff, whether transmitted via loudspeaker or personally, must be followed immediately and without fail. Failure to comply with instructions may result in expulsion from the event venue. In such cases, there is no entitlement to a refund of the ticket cost.
